These Terms of Use (the “Terms” or “Legal Terms”) are a legally binding agreement between you (“you”) and The Thomistic Institute (“Thomistic Institute,” “Aquinas 101,” “we,” “us,” or “our”) governing your access to and use of the Aquinas 101 website located at https://aquinas101.thomisticinstitute.org (the “Site”) and any related offerings, features, content, products, and services that link to these Terms (collectively, the “Services”).

ELIGIBILITY, ACCOUNTS, AND MINORS

The Services and our Site is not intended for children under 18 years of age. No one under age 18 may provide any Personal Information to or on the Site. We do not knowingly collect Personal Information from anyone under the age of 18. If you are under the age of 18, do not use or provide any information on this Site or through any of its features. We may require you to create an account for certain features. You agree to provide accurate information, maintain account security, and promptly notify us of any unauthorized access.

EDUCATIONAL PURPOSES AND DISCLAIMERS

Aquinas 101 provides educational content (including theological/philosophical instruction, videos, readings, quizzes, and related materials) for informational and educational purposes.

THE SERVICES DO NOT PROVIDE LEGAL, MEDICAL, THERAPEUTIC, OR OTHER PROFESSIONAL ADVICE. You are responsible for how you interpret and use the content.

PRIVACY, DATA RIGHTS, AND INTERNATIONAL USERS

Our collection and use of personal information is described in our Privacy Policy (the “Privacy Policy”), which is incorporated by reference into these Terms.

Depending on where you live, you may have rights to access, delete, correct, or opt out of certain processing of your personal information. We will honor applicable rights as described in the Privacy Policy and as required by applicable law.

If you access the Services from outside the United States, you understand your information may be processed in the United States and other jurisdictions where we and our service providers operate.

INTELLECTUAL PROPERTY

Our Content. The Services (including all site design, text, graphics, logos, audio/video, course content, compilations, software, and other materials) are owned by or licensed to us and are protected by intellectual property laws (“Content”). Our trademarks, service marks, and logos (“Marks”) are also protected.

Limited License. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services and Content for your personal, non-commercial educational use. Except as expressly permitted, you may not reproduce, distribute, publicly display, publicly perform, create derivative works from, or exploit any Content or Marks without our prior written permission.

ACCEPTABLE USE AND PROHIBITED CONDUCT

You agree not to:

  • Use the Services for unlawful purposes or in violation of any applicable law or regulation.

  • Scrape, crawl, harvest, or systematically extract data or Content from the Services except as permitted by robots.txt and standard search engine indexing.

  • Interfere with security features, rate limits, or access controls.

  • Upload or transmit malware, spyware, or code intended to disrupt or compromise the Services.

  • Impersonate any person or entity or misrepresent your affiliation.

  • Harass, threaten, or abuse others, or post unlawful, defamatory, obscene, or hateful content.

We may suspend or terminate access for violations.

USER SUBMISSIONS AND FEEDBACK

If you send us questions, comments, suggestions, ideas, or other feedback (“Feedback”), you grant us a worldwide, perpetual, irrevocable, royalty-free right to use, reproduce, modify, publish, and otherwise exploit that Feedback for any lawful purpose without compensation, except where prohibited by law.

Do not send confidential information through the Services or via email unless you have written authorization from us to do so.

THIRD-PARTY SERVICES AND LINKS

The Services may link to third-party websites or services or embed third-party tools. We do not control and are not responsible for third-party content, policies, or practices. Your dealings with third parties are between you and the third party.

PURCHASES AND DONATIONS

Prices and availability may change. Payment processing may be handled by third-party processors; your payment information is handled per their terms and our Privacy Policy.

Refunds. Unless otherwise stated at checkout or required by law, all sales are final. If refunds are available for a specific product, the refund policy will be displayed at purchase.

AVAILABILITY, CHANGES, AND DISCONTINUATION

We may modify, suspend, or discontinue the Services (in whole or in part) at any time. We are not liable for any interruption or loss of access.

CONTENT MODERATION AND COMPLAINTS (EU/EEA USERS)

We may restrict, remove, or disable access to user content or accounts that violate these Terms or applicable law. Our content moderation may involve automated tools and/or human review. Where we take action that affects your content or account, we may (where required) provide a notice explaining the decision and how to challenge it.

Internal complaint handling. If you believe we made an error in restricting your content or account, you can submit a complaint by contacting us at aquinas101support@dhs.edu with (i) your account identifier, (ii) the action you’re challenging, and (iii) relevant context. We will review and respond within a reasonable time.

Misuse. We may reject complaints that are manifestly unfounded or abusive.

TERMINATION

We may suspend or terminate your access to the Services at any time if we reasonably believe you violated these Terms, violated applicable law, or pose a security risk. Sections that by their nature should survive termination will survive (including IP, disclaimers, limitations of liability, dispute resolution, and indemnity).

INTERNATIONAL USE

The Site is controlled and operated by The Thomistic Institute from within the United States. Aquinas 101 makes no representations that materials contained within the Site are appropriate or available for use in other locations, and access to the Site from locations where such activity is illegal is prohibited. Those who choose to use the Site from other locations do so of their own initiative and are solely responsible for compliance with all applicable laws.

EXPORT

You agree to comply fully with all U.S. and foreign export laws and regulations to ensure that neither Aquinas 101 Services, nor any technical data related thereto, nor any direct product thereof, is exported or re-exported directly or indirectly in violation of, or used for any purposes prohibited by, such laws and regulations. By using the Site, you represent and warrant that: (1) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (2) you are not listed on any U.S. Government list of prohibited or restricted parties.

NO WARRANTY

CONTENT, INFORMATION, AND MATERIAL ON THIS SITE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF QUALITY, MERCHANTABILITY, NON-INFRINGEMENT, OR FITNESS FOR A PARTICULAR PURPOSE.

WITHOUT LIMITING THE FOREGOING, NEITHER AQUINAS 101 NOR ITS AFFILIATES MAKES ANY REPRESENTATION, WARRANTY, OR GUARANTEE (A) THAT THIS SITE WILL BE UNINTERRUPTED OR ERROR FREE OR THAT ANY INFORMATION, CONTENT, OR OTHER MATERIAL ACCESSIBLE FROM THIS SITE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; (B) REGARDING THE OPERATION OR PERFORMANCE OF THIS SITE; (C) REGARDING THE NATURE, OR ACCURACY OF ANY CONTENT, MATERIAL, OR PROCESS CONTAINED ON, DISTRIBUTED THROUGH, OR LINKED, DOWNLOADED, OR ACCESSED FROM THIS SITE OR ANY THIRD PARTY SITE; (D) ANY PRODUCT OR SERVICE PURCHASED ON OR THROUGH THIS SITE OR ANY THIRD PARTY SITE OR OBTAINED AS A RESULT OF ANY INFORMATION ON THIS SITE; OR (E) THE INTERNET GENERALLY. Any reliance you place on such information is strictly at your own risk. We disclaim all liability and responsibility arising from any reliance placed on such materials by you or any other visitor or user to the Site or the Content, or by anyone who may be informed of any of its contents.

This Site or the Content may include content provided by third parties, including materials provided by other users, third-party licensors, syndicators, aggregators and/or reporting services. All statements and/or opinions expressed in these materials, and all articles and responses to questions and other content, other than the content provided by Aquinas 101, are solely the opinions and the responsibility of the person or entity providing those materials. LIMITATION OF LIABILITY

AQUINAS 101 IS NOT LIABLE FOR ANY DAMAGES SUFFERED AS A RESULT OF YOUR USE OF THIS SITE. TO THE EXTENT PERMITTED BY LAW, IN NO EVENT WILL AQUINAS 101 BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF BUSINESS, REVENUE, PROFITS, USE, OR DATA) EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. COOPERATION WITH GOVERNMENT AGENCIES, LAW ENFORCEMENT, AND REQUIRED DISCLOSURES

You acknowledge that we have the right to investigate and prosecute violations of these Terms, including intellectual property, publicity, and privacy rights infringement and website security issues, to the fullest extent of the law. We may involve and cooperate with law enforcement authorities in prosecuting users who violate these Terms. You acknowledge that we have no obligation to monitor your access to or use of the Site or services we offer, but we have the right to do so for the purpose of operating the Site, to ensure your compliance with these Terms or to comply with applicable law or the order or requirement of a court, administrative agency, or other governmental or regulatory body.

You understand and agree that we may disclose your personal information if required to do so by law, court order, legal process, or subpoena, including to respond to any government or regulatory request (after, if permitted, giving reasonable notice to you and using commercially reasonable efforts to provide you with the opportunity to seek a protective order or the equivalent (at your expense), or if we believe that such action is necessary to (a) conform to the law, comply with legal process served on us or our affiliates or partners, or investigate, prevent, or take action regarding suspected or actual illegal activities; (b) to enforce these Terms (including for billing and collection purposes), take precautions against liability, to investigate and defend ourselves against any third-party claims or allegations, to assist government enforcement agencies, or to protect the security or integrity of our Site; or, (c) to exercise or protect the rights, property, or the safety of us, our users, or others.

BREACH OF THESE TERMS

If you violate any of these Terms, Aquinas 101 reserves the right to terminate or suspend, in whole or in part, without notice, your access to this Site or any of its Services. If any court finds that any provision of this agreement is illegal, invalid, or unenforceable, the remaining provisions will remain in full force and effect. These terms are not assignable by you, in whole or in part, to any third party and any attempt by you do so shall be void and of no force and effect.

GOVERNING LAW / JURISDICTION

These Terms are governed by the laws of the District of Columbia, USA. You and Aquinas 101 consent to the exclusive jurisdiction and venue of the courts located in the District of Columbia for any legal action connected in any way to these Terms or use of this Site or Services. You and Aquinas 101 waive any rights to a jury trial for any claim or cause of action arising out of these Terms or use of this Site and/or Services. However, if you are a consumer habitually resident in the EEA/UK/Switzerland, nothing in these Terms deprives you of mandatory protections of the laws of your country of residence, and you may bring claims in your local courts as described in the EEA/UK Consumer Addendum.

EEA/UK CONSUMER ADDENDUM

If you are a consumer habitually resident in the European Economic Area (EEA), the United Kingdom, or Switzerland, the following applies to the extent required by applicable law and will override any conflicting provision in these Terms:

  1. Mandatory consumer rights preserved. Nothing in these Terms limits or excludes any consumer rights that cannot be limited or excluded under the laws of your country of residence (including rights relating to non-conforming digital content/digital services, where applicable).

  2. Changes to these Terms. If we make changes that materially affect your rights or obligations, we will provide reasonable advance notice (for example, by posting a notice on the Site and/or emailing account holders where we have an email address). If you do not agree to the updated Terms, you may stop using the Site and, where applicable to a paid or ongoing service, you may cancel/terminate as described in the applicable terms of sale or subscription terms.

  3. Warranties and liability. The disclaimers and limitations of liability in these Terms apply only to the extent permitted by applicable law. In particular, we do not exclude or limit liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.

  4. Governing law and courts (EEA/UK consumers). You may bring a claim arising out of or relating to these Terms in the courts of the country where you are habitually resident, and you may also have the benefit of mandatory provisions of the law of that country even if these Terms state a different governing law.

  5. Out-of-court dispute resolution (EEA/UK consumers). You may be entitled to use an out-of-court dispute resolution body in your country.

ENTIRE AGREEMENT

These Terms of Use and our Privacy Policy constitute the sole and entire agreement between you and Aquinas 101 with respect to the Site. Aquinas 101’s obligations regarding Aquinas 101’s Services are governed by the terms of the agreements under which they are sold or licensed.

Aquinas 101 reserves the right to change these Terms, at any time, by posting the revised Terms on this Site and/or by emailing consumers. You should frequently review these Terms. If you continue to use this Site after changes to these Terms are made, you are indicating your agreement to the changes.
